These general conditions of sale govern the sale of the products presented on the au.colourful-deco.com website. They are concluded between the company CHALIZO SASU and any natural or legal person wishing to make a purchase from the website au.colourful-deco.com, and hereinafter referred to as “the customer”.
The company as well as the My colourful deco sites will hereinafter be referred to as My colourful deco.
These general conditions of sale are subject to French law. Any order assumes the customer’s full acceptance of these conditions.
The company is registered in the trade and companies register of Vannes (56, France) (56-France) under number 980 769 475.
Feature of the offer
My colourful deco undertakes to provide the customer with a product that conforms to the description given on its website.
My colourful deco, however, draws the customer’s attention to the fact that colors may be subject to variations depending on the type of computer equipment used (screen color management).
Price
The invoice price is the final total price, including the price of the items, as well as transport costs.
Order
The customer has the option of ordering online, on au.colourful-deco.com, according to the steps appearing online.
The system is designed to allow the customer to check their order at each stage, to identify any errors made during data entry and to correct them before final validation.
The order will only be definitively validated once full payment has been received.
My colourful deco reserves the right to refuse an order or request new confirmation from the customer, particularly in the following cases:
- Order greater than 2 products - Reasons linked to supply - Non-receipt of payment - All other reasons within the framework of current regulations
In the event of refusal of an order, My colourful deco will reimburse the sums collected and will inform the customer by any means at its disposal.
Payment
To finalize your order, you will have the choice of several payment methods made available depending on certain parameters of the order (amount, nature of the products, etc.):

Your order is manufactured after receipt of your payment.
Delivery
The products ordered are shipped to the address indicated by the customer in their order.
If the address given by the customer contains an error preventing delivery of the product, a supplement will be charged to the customer for a new delivery.
Withdrawal

Any unsatisfied customer may return their product and receive a refund.
In accordance with articles L.221-18 et seq. of the Consumer Code, the legal period for the right of withdrawal is fourteen clear days from receipt of the Product.
The Customer returning the Product as part of exercising his right of withdrawal has the right to reimbursement of the price of the Products ordered and the outbound delivery costs. The Customer who has exercised his right of withdrawal may, however, opt for an exchange or the issuance of a credit note.

The refund will be made no later than 14 days following receipt of the returned product.
Only the return or exchange of complete Products (accessories, instructions, etc.) and in perfect resalable condition (unsoiled, undamaged, unworn) will be accepted.
The costs of returning the Product goods remain the responsibility of the Customer.
If you use the right of withdrawal for only part of the Order, only the price invoiced for the returned Products will be refunded.
In the event of partial withdrawal of the Order, the Customer who would have benefited, during the initial Order, from free delivery due to exceeding a certain order amount, may be re-invoiced for the delivery costs corresponding to his actual order, if the latter fell below the threshold of free delivery.
Availability
Orders are placed as soon as possible and at the latest within a maximum period of 30 days from the day following that on which the customer transmitted their order to My colourful deco, and subject to stock availability.
In the event of unavailability of products after placing the order, the customer will be informed by e-mail and/or by telephone of the possibilities offered to them, including that of canceling their order.
If the debit occurred at the time of the information given on the unavailability of the product, My colourful deco will reimburse the customer for the sums due, by check or transfer as soon as possible and at the latest within a maximum period of 30 days from the information on the unavailability of the product initially ordered.
Guarantee
Our products are guaranteed for 2 years from the date of delivery of the product.
For any request regarding product warranty, the customer must contact My colourful deco by email or telephone.
My colourful deco will then indicate the procedure to follow.
Warranty Exclusion:
- Any product damaged due to external events not attributable to My colourful deco, due to wear, non-compliant installation and use, or negligence on the part of the customer. - Damage due to outdoor installation of products (example: discoloration due to the sun). - Any product modified, repaired, integrated or added by the customer cannot be covered under warranty. - Defects that may have been noted upon delivery of the product (cutting defects, material splinter?) cannot be covered under warranty if they are not reported by email to colourful-deco.au@spcs.store , within 2 days following delivery.
A delivery problem and/or product breakage and/or missing parts does not allow an order to be canceled, if My colourful deco is able to provide a solution within 90 days. Beyond that, the customer will be able to request a refund of their order.
Intellectual property
All elements of the My colourful deco website, such as models, photographs and texts, are protected by copyright and the provisions of the Intellectual Property Code.
Any total or partial reproduction of the My colourful deco catalog and its elements is strictly prohibited. Any criminal behavior will be subject to prosecution.
Responsibilities
My colourful deco could not be held responsible:

If, despite all the precautions taken, the fidelity (light, colorimetry, etc.) of one or more photographs presenting the products on its website was called into question; these photographs are not contractual. The stagings are presentation suggestions.

For damages of any nature, whether material, immaterial or bodily, which could result from the improper use or installation of the products sold.

For damage of any nature, whether material, immaterial or bodily, which could result from breakage or a fall of the product following wear or a defect in the latter (in particular the attachment systems of the different products). It is recommended to secure all products securely and install them in such a way that a fall of the product does not cause material, immaterial or bodily damage

For non-performance of the contract concluded due to the occurrence of events beyond its will and control, as defined by case law as cases of force majeure, disruptions, total or partial strikes (in particular postal services and means of transport and/or communications), flood, fire, accidents, administrative decisions, wars, natural disasters, riots.

For inconveniences and damages linked to the use of the Internet network, such as for example a break in service, the presence of computer viruses and external intrusions.
In any case, the total amount of sums that My colourful deco could be required to pay to the client, whatever the reason, is, by mutual agreement, limited by the parties to the sums actually received by My colourful deco under the this contract. And this from the date on which the event giving rise to its liability occurs, and whatever the legal basis of the claim and the procedure used to bring it to fruition.
Disputes
Complaints or disputes will always be received with attentive kindness.
In the event of a dispute, the customer will contact My colourful deco to seek an amicable solution with it, before any legal action. The search for an amicable solution does not interrupt the deadlines for acting under guarantee.
These general conditions of sale are subject to French law. In the event of a dispute, the place of performance and the competent court: RCS at Vannes (56, France).
Validity
These general conditions of sale are valid for the entire duration of the online availability of the services offered by My colourful deco.
If one of the clauses of these conditions were to change, or to be considered null and void following a change in legislation, regulations or court decision, the other clauses of these general conditions of sale will remain valid.
The current version was updated on the date indicated above.
Unilateral modifications to the general conditions of sale which may have occurred subsequent to the conclusion of the sales contract will not be binding on the customer.
Personal data
Each order requires My colourful deco to collect the customer’s personal data, in particular the email address, through which the customer receives an order confirmation. This personal data is only used in the context of transactions and offers from My colourful deco, which does not intend to transfer or distribute this data to third parties.
In accordance with Law No. 78-17 of January 6, 1978 amended by Law No. 2004-801 of August 6, 2004, the customer has at any time a right of access, opposition and rectification of personal data concerning him.
To exercise this right, the customer will send his request, either by e-mail to the address colourful-deco.au@spcs.store, or by post to the following address: CHALIZO SASU - My colourful deco, 15 impasse Poulmenach 56370 SARZEAU France By imperatively specifying: their email address, their last name, first name, address.
